SECORD TOWNSHIP SPECIAL ASSSESSMENT DISTRICT HEARING

THENDARA AREA

January 26, 2008

Supervisor Pat Dean opening with the Pledge of Allegiance to the Flag called the meeting to order at 10 AM.  Clerk, Kathie Hart and Trustees Mike Fagan and Vince Barry were present.  Treasurer, Jan Alley, was excused.

Motion by Fagan and Barry to approve the meeting minutes from the January 5, 2008 Special Assessment District Meeting.  MC

Bill Karbowski of B&K Appraisal provided a presentation of the area in question and reiterated the fact that since the road was owned by Clement Township Secord Township money could not be used to assist Clement in the project since statutes specifically state the township money can only bu used to improve roads within the township.  Mr. Karbowski also advised that appeals need to be provided in writing or appear in person.

The floor was opened for comments by attendees both in favor and against the proposed program.

§         Comments against the proposal:

o        Dean advised that 4 letters were received against the project and letters were read.

§         Comments for the proposal:

o       Residents signed in at the meeting all agreed to proceed with the proposal

The public hearing was then closed at 10:09 AM.

Deliberation and decision by Board meeting opened at 10:10 AM.

After discussion:

Motion by Dean and Barry to pass the following resolution:

THENDARA AREA

 

RESOLUTION 2008-03

WHEREAS, the Township Board of the Township of Secord, Gladwin County, Michigan, after due and legal notice has conducted a public hearing upon the proposed assessment roll prepared by the Supervisor and the assessing Officer of the Township for the purpose of defraying a portion of the cost associated with a joint 50/50 road construction project of one half mile of Pineway Dr. in Clement Township The Special Assessment District No. 2008-01 as shown on the plans and specification for such project.

AND WHEREAS, such public hearing was preceded by proper notice in the Gladwin County Record. A newspaper of general circulation in the Township and by First Class mail notice to each property owner of record within said district and upon said assessment roll,

AND WHEREAS, comments were received from those present at such public hearing on 1-26-2008 at 10:00AM at the Secord Township Hall, concerning said assessment roll and opportunity to be heard in the matter.

AND WHEREAS, record of those present to protest and of written protest submitted on or before the public hearing was made part of the minutes of the hearing,

AND WHEREAS, it is the opinion of the Township Board that no further time should be granted for consideration of the matter,

AND WHEREAS, the Township Board has duly inspected the proposed assessment roll and considered all comments presented and has found the proposed assessment roll presented to be correct, just and reasonable,

NOW THEREFORE IT BE RESOLVED AS FOLLOWS,      

1.  The assessment Roll submitted by the Supervisor and Assessing Officer of the Township shall hereafter be      designated as Secord Special Assessment Roll, Thendara Area, No. 2008-03.

2.     The assessment in said Secord Township Assessment Roll 2008-03 shall be divided into Two (2) equal annual installments of Principal with the first installment due on or before February 28, 2009 and the last installment due on or before the 28th day of February 2010. All unpaid installments prior to their transfer to the tax roll as provided by the Michigan Public Act 188 of 1954, as amended shall bear interest annually on each installment

due at the rate of 12 percent per annum commencing on the first installment due date herein before set forth. Any payment made before such first installment date shall not bear any such interest.

3.     Future due installments of as assessment against any parcel of land may be paid to the

Secord Township Treasurer at any time in full with interest accrued through the month in which the final installment is paid in accordance with Michigan Public Act 188 of 1954 as amended. If any installment of a special assessment is not paid when due, then the installment shall be considered to be delinquent and there shall be collected, in addition to interest provided by this section, a penalty at the rate of 1% for each month, or fraction of a month, that the installment remains unpaid before being reported to the Township Board for reassessment upon the township tax roll, also in accordance with said Act188.

4.     The assessment made in said special assessment roll and hereby ordered to be collected by the Secord Township Treasurer and the Secord Township Clerk shall deliver said Assessment Roll to said Treasurer with his/her warrant attached, commanding the Treasurer to collect such assessments in accordance with the direction of the Secord Township Board and Public Act 188.

5.     All resolutions and parts if resolution insofar as to conflict with the provision of this resolution and the same are hereby rescinded

Upon a roll call vote on the adoption of the resolution, the following voted

RESOLUTION

 

2008-04

WHEREAS, The Board of Secord Township has created a Special Assessment District with Resolution 2008-01 which encompasses all property within the Thendara Area within Secord Township.  All the property is located on the following named streets; E. Thendara Dr., W. Thendara Dr., Thendara Court and Peninsular Dr. as well as small private drives off the above mentioned streets.

WHEREAS, a property owner shall only be assessed for one parcel of property within the Township for the purpose of this assessment, and,

WHEREAS, the following cost s have been established for the Special Assessment District for the next two years:

            Contract Cost: Not to exceed           $50,825.00

            Administrative Cost                                2,935.00

            Total                                                      $53,760.00

Therefore be it resolved that the cost shall be assessed as follows:

Each property owner shall be assessed $280.00 each year for a total of $560.00 for the life of the District.  Said property owners have the option of paying the $560.00 up front if they wish.
