SECORD TOWNSHIP PLANNING COMMISSION DECEMBER 12, 2007 @ 10:00am MINUTES Meeting called to order @ 10:00am by Thelma Mitchell Pledge of allegiance was recited Roll call: Chairperson......Thelma Mitchell present Tony Reale present Merv Raden present Mike Fagan present Colin Combs present Rex Rowe present Secretary.......Patt Barry present Zoning-Admin...Jim Carroll present Minutes of October 10, 2007 accepted by Mike Fagan seconded by Tony Reale. Minutes to be submitted. OLD BUSINESS: 1. Discussion of Ordinance on Non-Conforming Homes; pg 45 under 502: Non-Conforming Uses and Structures: # 502:I GENERAL RULES FOR NON=CONFORMING USES AND STRUCTURES # 9 on page 49.In the event that a non-conforming use or structure has been accidentally destroyed or damaged to any extent, such non-conforming use or structure may be repaired or replaced providing reconstruction does not in any way increase its non-conforming use. If necessary, such determination shall be made by the Township Zoning Board of Appeals. Any debris that is remaining as a result of the destruction or damage shall be removed from the site within thirty (30) days. Also providing that substantial evidence of construction be shown within the subsequent twelve (12) month period. AMEND TO READ: IN THE EVENT THAT A NON-CONFORMING USE OR STRUCTURE HAS BEEN ACCIDENTALLY DESTROYED OR DAMAGED TO ANY EXTENT, SUCH NON-CONFORMING USE OR STRUCTURE MAY BE REPAIRED OR REPLACED PROVIDING RECONSTRUCTION DOES NOT IN ANY WAY INCREASE ITS FOOTPRINT. IF NECESSARY, SUCH DETERMINATION SHALL BE MADE BY THE TOWNSHIP ZONING BOARD OF APPEALS. ANY DEBRIS THAT IS REMAINING AS A RESULT OF THE DESTRUCTION OR DAMAGE SHALL BE REMOVED FROM THE SITE WITHIN THIRTY (30) DAYS. ALSO PROVIDING THAT SUBSTANIAL EVIDENCE OF CONSTRUCTION BE SHOWN WITHIN THE SUBSEQUENT TWELVE (12) MONTH PERIOD. 1. Re: pg. 54; 503:5 “REQUIREMENTS FOR PARKING AREAS, # E No part of any public or private parking area, regardless of the number of spaces provided, shall be closer than twenty (20) feet to the street right-of way. AMEND TO READ: E. NO PART OF ANY PUBLIC OR PRIVATE PARKING AREA, REGARDLESS OF THE NUMBER OF SPACES PROVIDED, SHALL BE CLOSER THAN TWENTY-FIVE FEET (25) TO THE STREET RIGHT-OF WAY AND CLOSER THAN FORTY (40) FEET FROM THE WATER EDGE. 2. Up-date Master Plan Book and updating Maps 3. Election for Vice-Chair was voted on with nomination of Rex Rowe suggested by Chairperson Thelma Mitchell; with Merv Raden nominating Rex Rowe for Vice-Chair and Mike Fagan seconded. All ayes: Thelma Mitchell, Merv Raden, Mike Fagan, Tony Reale, & Patt Barry. Vice-Chair elect is Rex Rowe 4. Replacing Secretary Patt Barry; Jenny Carroll to accept after first meeting of 2008. December 12, 2007 Minutes 5. MEETINGS FOR 2008 as follows: APRIL 9TH MAY 14TH JULY 9TH AUGUST 13TH OCTOBER 8TH DECEMBER 10TH All meetings at 10:00am unless it is necessary to schedule an evening meeting.
